DISCLAIMER
SeekaHost Ltd. agrees to provide services to the users who have subscribed and are using our services, subject to the following (“Terms and Conditions”). SeekaHost Ltd., the company hereafter referred to as, (“SeekaHost Game Hosting”), (“Us”), (“We”) and The Client, (“Customer”), (“Client”) and (“You”). Use of SeekaHost Game Hosting Service constitutes acceptance and agreement to AUP (“Adequate Use Policy”) and T&C’s (“Terms and Conditions”). All provisions of this contract are subject to change from time to time at the discretion of SeekaHost. Every Subscriber will be informed about changes to the T&C’s by SeekaHost Ltd. on this page and it’s the subscribers responsibility check this page when using/upgrading the services provided by SeekaHost Ltd.
REFUNDS AND DISPUTES
Minecraft servers are eligible for refunds within one twenty-four-hour day of the creation of the server in the SeekaHost database. The timing can differ to the time your initial payment is processed by several hours or days. All refunds are made through the gateway in which initial payments were made. For any other services such as server setup and Minecraft game server consultation, there will be no refunds and work is performed after the payment is made. For all game server hosting package on this website (https://www.seekahost.co which is connected to submain at https://portal.seekahost.co/ ) the Subscriber must request a refund through issuing one ticket through our support system via the client area – https://portal.seekahost.co/clientarea.php withing 24 hours of purchase of a respective hosting plan. SeekaHost 24-hour money back guarantee ONLY applies to a new client’s first order. Refunds issued for billing errors are released on an individual case basis.
CANCELLATIONS
To terminate your account and Minecraft sever hosting services with SeekaHost you must cancel any PayPal active subscriptions and cancel your booked services via our SeekaHost billing area at https://portal.seekahost.co/clientarea.php and open a support ticket requesting your cancellation. Because SeekaHost does not have access to clients’ PayPal accounts we cannot and will not be responsible for unintended payments made from using the automatic payment subscription service set up by the Subscriber.
LIABILITY LIMITATION AND EXCLUSION
SeekaHost Game Hosting shall not be held liable for any data loss, disruption of service or information, or distribution of information including that of unauthorized access to our server systems or any other loss of data, under no circumstances. SeekaHost Game Hosting shall not be held liable for any disruption, delay, or disconnection of services for any period of time. SeekaHost reserves the right to terminate a client’s game hosting services in the event of a charge dispute, no matter the outcome of the dispute.
SUPPORT
Any support requests required for products from SeekaHost Game Hosting website (www.seekahost.co and connected SeekaHost web pages) shall be submitted through the client area – https://portal.seekahost.co/ via tickets or the 24/7 live chat. Any other form of contact other than the predetermined ticket and support system will not guarantee a response from an official representative.
PROMOTIONS
SeekaHost Game Hosting cannot guarantee that all promotion codes will work all the time.
LEGAL LIAISON
SeekaHost Game Hosting retains the right to seek and consult with any appropriate authorities that may need to be involved in the event of any legal issue arising whether it is through violation of this policy or any other illegal occurrence requiring involvement of law-enforcement agencies. SeekaHost Game Hosting regards any communication between parties as confidential, upon distribution of any communication, unless prior approval is in place, we will take action to the full extent of the law. By purchasing a server from SeekaHost Game Hosting you allow us to modify your server, this includes, but is not limited to, changing plugins, updating Bukkit and other tasks related to running a Minecraft server. Any verbal or written actions to compromise the safety and running of our server systems or any other equipment owned by SeekaHost Game Hosting will be taken seriously and will result in further investigation and possible legal prosecution. Upon cancellation of payments to SeekaHost Game Hosting your server will be suspended unless prior arrangements are made. The Subscriber shall only supply to SeekaHost Ltd., and the Host shall only process, in each case under or in relation to the Contract, the Personal Data of the Subscriber of the following types: names, DOB, addresses, email addresses, telephone numbers, bank details; and SeekaHost Ltd. shall only process the Subscriber Personal Data for the following purposes: account registration, game server hosting, customer communication, internal administration.
SeekaHost Ltd. shall only process the Subscriber Personal Data during the Term and for not more than 30 days following the end of the Term, unless agreed otherwise. SeekaHost Ltd. shall only process the Subscriber Personal Data on the documented instructions of the Subscriber (including with regard to transfers of the Customer Personal Data to any place outside the European Economic Area). SeekaHost Ltd. shall promptly inform the Subscriber if, in the opinion of the Host, an instruction of the Subscriber relating to the processing of the Customer Personal Data infringes the Data Protection Laws of England and the European Union. SeekaHost Game Hosting retains the sole right to stop, start, and modify your server.
TERMINATION
Additionally, we reserve all rights to terminate a Subscriber server or service upon any violation of these terms and conditions or any other basis if required.
ELECTRONIC COMMUNICATIONS
When you use any SeekaHost Game Hosting Service, or send e-mails, submit support tickets, and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically via e-mail, live chat or by posting messages on this site.
OTHER MINECRAFT SERVER HOSTING TERMS
By subscribing to use Minecraft server on SeekaHost you are agreeing to the terms and conditions of using the Minecraft game according to their user standards. And also, you are giving your consent for us to use your provided user registration details to host you Minecraft server. You can also read the user agreements of and terms of using Minecraft and the Minecraft End User Licence Agreement.
ADEQUATE USE POLICY
ILLEGAL USE
SeekaHost Game Hosting services may not be used for illegal purposes, or in support of illegal activities. SeekaHost Ltd. reserves the right to cooperate with legal authorities and/or affected third parties in the investigation of any suspected crime or civil wrongdoing.
THREATS
Using of the SeekaHost Game Hosting services to transmit any material (by e-mail, uploading, posting or otherwise) threatening or encouraging bodily or mental harm or destruction of property is prohibited.
HARASSMENT
Using the SeekaHost Game Hosting services to transmit any harmful or illegal material (by e-mail, uploading, posting or otherwise) that harasses another is prohibited.
FORGERY OR IMPERSONATION
Adding, removing, or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
FRAUDULENT ACTIVITY
Use of SeekaHost Game Hosting services to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as “pyramid schemes” and “chain letters” is prohibited. Fraud involves a knowing misrepresentation or misleading statement, in writing or in the form of an activity made with the intent that the person receiving it will act upon it. Fraud is strictly prohibited, and offences will be investigated.
UNAUTHORIZED ACCESS
Use of SeekaHost Game Hosting services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of SeekaHost Game Hosting or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and offending the SeekaHost Game Hosting account is subject to immediate termination and further investigation.
ILLEGAL NETWORK ACCESS AND ACTIVITY
Use of the SeekaHost Game Hosting service for any activity which affects the ability of other people or systems to use SeekaHost Game Hosting Services or the Internet is forbidden. This includes “Denial of Service” (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Subscriber’s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that it gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized access and/or use of another company and/or individual’s computer system will result in immediate account termination. SeekaHost Game Hosting will not tolerate any Subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
Third-party Links, Sites and Services
Our websites may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by SeekaHost Game Hosting. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content via SeekaHost.co, you do so at your own risk and you agree that SeekaHost Ltd. will have no liability arising from your use of or access to any third-party website, service, or content.
Server usage & storing unwanted files storage terms and conditions.
The user can only backup the Minecraft world one time and any other zip files, videos should not be stored in the server. If such files, data, video are stored other than your Minecraft world (one backup) it will be deleted from the server automatically.
- The total size of the backup file under your account should not exceed 10GB. Please use external storage to store any additional backups.
- If you use the Dynmap or Bluemap plugins, the map files should not exceed 10GB. And for this reason, we restrict Dynmap to a maximum resolution of ‘lowres’ for sufficient usage requirements.
SeekaHost will not take responsibility for the customer’s use of any custom jar file or files uploaded by the user/customer without notifying us for approval. If the user/customer uploaded files that cause disruptions to the server such as a crash, lag or make the server unresponsive, SeekaHost is not responsible and liable. If the SeekaHost staff discover unfair usage of the SeekaHost Minecraft server the customer is renting, using tricks/commands to manipulate the usage of the server slots, CPU and or RAM usage, the server is subject to being terminated without any refund.
